A man was killed in Los Angeles, Tuesday, Sept. 25, after a fight between rival viagra manufacturers, who wanted to sell Viagra for men, over the weekend, according to a court filing.
According to court records, the court heard that the male impotence drug, which had been on the market since 1998, had been developed with the assistance of Pfizer Inc.
In the meantime, Viagra had been approved by the Food and Drug Administration for the treatment of erectile dysfunction and as a prescription drug, according to the court filing.
Pfizer, which was involved in the litigation, has a patent for Viagra that expires on March 11, 2014. The drug is now available only as a generic, meaning the patent has been in effect for about a year.
The court filing stated that Pfizer had promised to sell its Viagra product for less than one dollar per gram, but that the company "has no intention of making a substantial or even major change to the structure of the patent."
The lawsuit, which was filed in Los Angeles Superior Court on Friday, was filed by three men who had purchased the drug from Pfizer, according to the court filing. They said the Viagra patent was invalid for several reasons. First, they said, the drug was not manufactured for sale by Pfizer.
Second, they said, the Viagra patent was invalid because the product was a product of Pfizer, an off-patent company.
Third, they said, the Viagra patent was invalid because the drug was not approved by the FDA for use in the treatment of male erectile dysfunction.
The drug was originally approved by the Food and Drug Administration for the treatment of erectile dysfunction in 1998, but had since been approved for other uses, including the treatment of pulmonary arterial hypertension.
Viagra has been approved for the treatment of erectile dysfunction in men under the age of 40 and is available in a number of dosages.
The company had said in a statement: "The court finds that the use of the product by a man for the treatment of erectile dysfunction was illegal under the Food and Drug Administration Act. As such, the court orders that the product be sold under the brand name Viagra, and that the patent for this product be granted immediately."
